2. These Terms

These Terms & Conditions apply to products purchased through the AerosolsRus website.

Separate policies also apply to your purchase, including our:

  • Returns & Refunds Policy
  • Delivery Policy
  • Privacy Policy

These policies form part of our overall terms where applicable.

Nothing in these terms is intended to remove or restrict any statutory rights you may have.

3. Our Products

We supply both standard stock products and products that are custom-filled, custom-mixed or prepared specifically to a customer's requirements.

Product descriptions, photographs, colours, dimensions, specifications and availability are provided as accurately as reasonably possible.

Images shown on our website are for illustration and colour reference purposes. Actual colour appearance can vary according to lighting, viewing conditions, monitors, substrates, existing coatings and finish.

Some products may be subject to availability, manufacturer changes or supplier availability.

4. Custom-Filled Aerosols & Made-to-Order Products

A significant part of our business involves producing aerosols specifically to a customer's requirements.

Custom products may include aerosols selected or specified by:

Colour • Colour Reference • Finish • Product Type

This can include products made to RAL, BS, Pantone, manufacturer or brand colours, colour names, HEX/LAB values and other customer-supplied colour information.

A custom-filled product is made specifically for the individual customer's requirements.

Please check your order carefully

Before placing an order for a custom product, you are responsible for checking that the selected:

Colour • Colour Reference • Finish • Product Type • Quantity

are correct.

Once production has commenced, a correctly manufactured custom product cannot normally be cancelled or returned simply because you have changed your mind or selected a different colour, finish or product type.

Our Returns & Refunds Policy provides further information.

This does not affect your statutory rights where we have supplied the wrong product, wrong colour or wrong specification, or where the product is faulty, damaged, misdescribed or otherwise does not conform to the contract.

5. Colour Matching

We offer colour matching and colour specification services across a wide range of recognised colour standards, brand colours and specialist requirements.

Where a recognised colour reference is supplied, we will use the information provided to manufacture or prepare the product.

A colour reference should always be checked carefully before ordering.

Where you are unsure of the colour, coating system or product required, we recommend using our Paint Finder, colour tools or contacting our paint team before placing an order.

A colour displayed on a computer, tablet or telephone screen should not be treated as a guaranteed representation of the final physical paint colour.

6. Colour Matching From Samples

Where a customer supplies a physical sample or other information for colour matching, the resulting colour is a professional colour match based on the information and sample available to us.

Variations can occur due to the condition, age, substrate, lighting and original finish of the supplied sample.

Where exact reproduction is critical, customers should discuss their requirements with us before ordering.

7. Selecting the Correct Product

Customers are responsible for providing accurate information about the surface, substrate and intended application where they are asking us to recommend or supply a product.

Our website provides preparation, product and project guidance to assist with product selection.

Where specialist advice is required, please contact us before placing your order.

Unless we have expressly agreed otherwise, customers should ensure that the chosen product is suitable for the intended application and that the manufacturer's instructions, Technical Data Sheet and Safety Data Sheet are followed.

Nothing in this section affects your statutory rights.

8. Product Safety

Some AerosolsRus products are pressurised, flammable, solvent-based or otherwise subject to specific handling, storage and application requirements.

Customers must read and follow the relevant product information, including applicable labels, Technical Data Sheets and Safety Data Sheets.

Products must only be used for their intended purpose and in accordance with the manufacturer's instructions.

Aerosols and other hazardous products must be stored, transported and used responsibly.

Do not return an aerosol or other hazardous product without contacting us first.

9. Prices

All prices displayed on our website are stated in GBP (£) and, where applicable, include VAT at the prevailing rate.

Delivery charges are shown separately unless expressly stated otherwise.

We reserve the right to change prices, products and offers before an order is accepted.

If an obvious pricing or technical error has resulted in an incorrect price being displayed, we may contact you before accepting the order.

We will not knowingly rely on an obvious error to the detriment of a customer.

10. Orders

When you place an order through our website, you are making an offer to purchase the products selected.

After placing an order, you will normally receive an acknowledgement confirming that we have received your order.

Receipt of an order acknowledgement does not necessarily mean that the order has been accepted.

We may need to contact you if:

  • a product is unavailable;
  • information supplied is incomplete or unclear;
  • a colour or specification requires clarification;
  • there is an obvious pricing error;
  • delivery cannot be made to the selected address; or
  • we identify another issue that prevents us from fulfilling the order.

Where an order cannot be fulfilled, we will contact you and, where payment has already been taken, arrange the appropriate refund.

11. Custom Production

Where an order contains a custom-filled, custom-mixed or made-to-order product, we may need to prepare or manufacture that product before dispatch.

Our 13:00 dispatch cut-off applies to orders that are ready and eligible for dispatch.

A custom product may require additional preparation time depending on the nature of the order.

Where production has commenced, cancellation may no longer be possible for a change of mind.

12. Payment

Payment must be made using one of the payment methods offered at checkout.

Payment must be successfully authorised before an order can normally be processed or dispatched.

If payment is declined, reversed or otherwise fails, we may be unable to process or dispatch the order until payment has been successfully completed.

13. Dispatch & Delivery

Our Delivery Policy explains our delivery services and charges in full.

Our normal working-day dispatch cut-off is:

13:00 Monday to Friday

Orders placed before 13:00 on a working day will normally be processed for same-day dispatch, subject to product availability, custom production requirements and necessary checks.

Orders placed after 13:00 will normally move to the next working day for dispatch.

Next Working Day Delivery

Our Prime Next Working Day service relates to delivery on the next working day following dispatch.

It does not mean the next calendar day after the order is placed.

For example:

  • Friday before 13:00: dispatched Friday → normally delivered Monday.
  • Friday after 13:00: dispatched Monday → normally delivered Tuesday.
  • Friday after 13:00 before a Monday Bank Holiday: dispatched Tuesday → normally delivered Wednesday.

Weekends and Bank Holidays do not normally count as working days.

Please read our separate Delivery Policy for full information.

14. Delivery Addresses

Customers are responsible for providing a complete and accurate delivery address.

We cannot be responsible for delays caused by incorrect or incomplete information supplied at checkout.

Additional delivery charges may apply to certain Scottish Highlands, Scottish Remote & Offshore, island and other remote postcodes.

Where applicable, these charges will be shown during checkout.

15. Risk & Delivery

We will arrange dispatch of your order using the delivery service selected at checkout.

Where tracking is available, tracking information will normally be provided after dispatch.

If a delivery is delayed, please contact us and we will assist where possible.

Nothing in these terms limits your statutory rights concerning delivery or goods that do not conform to the contract.

16. Inspection on Delivery

Customers should inspect their order as soon as reasonably possible after delivery.

If your order arrives damaged, please photograph the packaging and products before disposing of the packaging.

If you have received the wrong product, wrong colour, incorrect specification or a faulty product, please contact us promptly so that we can investigate and provide the appropriate remedy.

17. Returns & Refunds

Our separate Returns & Refunds Policy explains the arrangements for returns, refunds and cancellations.

Standard stock products may be eligible for a change-of-mind return subject to the conditions of that policy.

Custom-filled, custom-mixed and made-to-order products are treated differently because they have been produced specifically to the customer's requirements.

Nothing in our Returns & Refunds Policy or these Terms & Conditions removes any statutory rights that apply to faulty, misdescribed, damaged or incorrectly supplied goods.

18. Incorrect Colour or Specification

If we supply a colour or specification that does not correspond with the order you placed, please contact us as soon as possible.

We will compare the product supplied against the colour and specification recorded on the order.

Where the error is ours, we will put the matter right.

Depending on the circumstances, this may include providing a replacement or refund.

Where the product has been correctly manufactured to the colour and specification selected by the customer, a subsequent request for a different colour or specification will normally be treated as a change-of-mind request for a custom-made product.

19. Faulty or Defective Products

If a product is faulty or defective, please contact us with your order number and details of the problem.

Where appropriate, we may ask for photographs, batch information or other information to help us investigate.

Where goods do not meet the standards required by law, we will provide the remedy required by applicable law.

Consumers have statutory rights relating to goods being as described, of satisfactory quality and fit for purpose. Nothing in these terms is intended to exclude or restrict those rights.

20. Customer Responsibilities

Customers are responsible for:

  • providing accurate order and delivery information;
  • checking colour, finish, product type and quantity before ordering;
  • ensuring that the intended surface and application are suitable for the selected product;
  • following preparation and application instructions;
  • following product labels, TDS and SDS information;
  • using appropriate PPE and ventilation where required; and
  • using products safely and for their intended purpose.

These responsibilities do not affect any statutory rights you may have.

21. Our Website & Information

We make reasonable efforts to ensure that information on the website is accurate and up to date.

However, the website may occasionally contain typographical, technical, pricing or other errors.

We may correct errors or update product information where necessary.

Where an error materially affects an order that has not yet been accepted, we may contact you before proceeding.

22. Availability

We make reasonable efforts to keep products available for purchase.

However, products may occasionally become unavailable due to stock levels, supplier availability, manufacturing issues or other circumstances.

Where we cannot fulfil an order, we will contact you and arrange the appropriate solution.

23. Intellectual Property

All content on the AerosolsRus website, including our branding, logos, photographs, graphics, written material, guides, tools and website design, is owned by or licensed to Tameside Paints & Supplies Ltd unless otherwise stated.

You may not reproduce, copy, modify, distribute or commercially use our website content without our written permission.

24. Links to Other Websites

Our website may contain links to external websites or services.

These links are provided for convenience and information.

We are not responsible for the content, availability or operation of websites operated by third parties.

25. Limitation of Liability

Nothing in these terms excludes or limits any liability that cannot legally be excluded or limited.

In particular, nothing in these terms excludes or limits liability relating to:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • faulty or misdescribed goods where the law prevents such liability being excluded; or
  • any other liability that cannot legally be excluded or restricted.

Where you are a consumer, nothing in these terms is intended to remove or restrict your statutory rights.

26. Business Customers

Where a customer purchases products wholly or mainly for business purposes, certain consumer protections may not apply and different contractual rules may apply.

Nothing in these terms is intended to give a business customer fewer rights than those applicable by law.

Where a separate written quotation, trade agreement or account agreement has been provided and accepted, that agreement may contain additional terms applying specifically to that transaction.

27. Privacy

We process personal information in accordance with our Privacy Policy.

Please refer to our Privacy Policy for information about how we collect, use and protect personal information.

28. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, products, services or legal requirements.

The terms applicable to your order will be the terms in force when you place your order, unless a change is required by law or otherwise applies to an existing contract.

29. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Where you are a consumer, you will also retain any mandatory protections and rights provided to you by the law that applies to your circumstances.
